Right to data portability

You have a right to obtain and re-use your personal data

You have a right to obtain and re-use your personal data for your own purposes across different services – this is referred to as the right to data portability. This allows you to move, copy or transfer personal data easily from one IT environment to another in a safe and secure way.  This has more relevance to consumer services than it does within the context of student finance customers or employees of SLC.  Furthermore, the right to data portability only applies:

  • to personal data you have provided to SLC;
  • where the processing is based on consent or for the performance of a contract; and
  • when processing is carried out by automated means

SLC will provide the personal data in a structured, commonly used and machine readable form. Open formats include CSV files. Machine readable means that the information is structured so that software can extract specific elements of the data. This will enable other organisations to use the data.  If requested, we will transmit the data directly to another organisation if this is technically feasible.  The information will be provided free of charge.

We will respond to your request without undue delay, and within one month.  This can be extended by two months where the request is complex or we receive a number of requests.  We will inform you within one month of the receipt of the request and explain why the extension is necessary.

Where we are not taking action in response to a request, we will explain why and inform you of your right to complain to the supervisory authority and to a judicial remedy.
