Right to erasure

You have a right to request that your personal data is removed or deleted. The right to erasure is also known as ‘the right to be forgotten’.

You have the right to request the deletion or removal of your personal data if:

  • the personal data is no longer necessary for the purpose for which it was  originally collected;
  • we are relying on your consent as our lawful basis for holding the data and you withdraw this consent;
  • you object to the processing of your data and there is no overriding legitimate interest to continue this processing;
  • we are processing the personal data for direct marketing purposes and you object to that processing;
  • we have processed the personal data unlawfully;
  • we have to do it to comply with a legal obligation; and/or
  • we have processed the personal data to offer information society services to a child.

You must provide the following information in order to allow SLC to authenticate your details:

  • Name
  • Address
  • Date of Birth
  • Customer Reference Number or National Insurance Number (NINO)

We will respond to your request within one month.  We may refuse to comply with a request for erasure if the request is manifestly unfounded or excessive, taking into account whether the request is repetitive in nature.  If this is the case, we may:

  • request a "reasonable fee"  to deal with the request; or
  • refuse to deal with the request.

In either case we will contact you to explain this decision.

A reasonable fee will be based on the administrative costs of complying with the request.  If we decide to charge a fee, we will contact you.  Once we have received the fee, we will comply with your request.
